1. Definitions

• "Customer," "you," or "your" refers to the individual or entity engaging our trucking, hauling, or logistics services.
• "Services" refers to the entire range of operations offered by THE FAMILY TRUCKING & HAULING LLC, including but not limited to transportation, logistics management, freight hauling, and related activities.

2. Service Agreement

All services provided by THE FAMILY TRUCKING & HAULING LLC are subject to a separate service agreement or bill of lading which will detail specific terms, pricing, schedules, and responsibilities. These Terms and Conditions shall govern such agreements unless explicitly superseded by a signed, written document.

3. Customer Responsibilities

As a customer, you agree to:

• Provide accurate and complete information regarding the cargo, including its nature, dimensions, weight, and any special handling instructions or hazards.
• Ensure that all cargo is properly packaged, labeled, and prepared for transportation in accordance with applicable laws and industry standards.
• Comply with all governmental regulations related to the transportation of your cargo.
• Be responsible for the accuracy of all documentation, including bills of lading, customs declarations, and permits.
• Arrange for timely loading and unloading of cargo as per the agreed schedule.

4. Payment Terms

Payment terms will be established in the individual service agreement. Unless otherwise specified, invoices are due upon receipt. Interest may be charged on overdue amounts at a rate of 1.5% per month or the maximum rate permitted by law, whichever is less. THE FAMILY TRUCKING & HAULING LLC reserves the right to hold cargo in the event of non-payment.

5. Limitation of Liability

THE FAMILY TRUCKING & HAULING LLC will exercise reasonable care in the handling and transportation of cargo. However, our liability for loss, damage, or delay to cargo is limited by the terms of the Bill of Lading, tariff, and applicable laws, including the Carmack Amendment (49 U.S.C. § 14706) if applicable. For specific limitations, please refer to your service agreement. We are not liable for consequential, incidental, or indirect damages.

6. Claims

Any claims for loss, damage, or delay must be submitted in writing to THE FAMILY TRUCKING & HAULING LLC at 276 GLEN CROSSING DR, ETNA, OH, 43062 within 9 months of the date of delivery (or the date delivery should have been made). Legal action for such claims must be initiated within 2 years and 1 day from the date the carrier disallows the claim or any part thereof.

7. Indemnification

You agree to indemnify, defend, and hold harmless THE FAMILY TRUCKING & HAULING LLC, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your breach of these Terms, your improper use of our services, or your violation of any laws or rights of a third party.

8. Force Majeure

THE FAMILY TRUCKING & HAULING LLC shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

9. Governing Law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

10. Amendments to Terms

We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our website and will be effective immediately upon posting. Your continued use of our services after any such amendments constitutes your acceptance of the new Terms.
